Vail Management Rental Agreement

THIS FORM HAS NOT BEEN APPROVED BY THE COLORADO REAL ESTATE COMMISSION, BUT WAS PREPARED BY JOHNSON & REPUCCI LLP, LOUISVILLE, COLORADO, AS LEGAL COUNSEL TO VAIL MANAGEMENT COMPANY  

 

This Colorado Residential Short Term Occupancy Agreement Statement of Terms and Condition (“Agreement”) is between Guest reservation name (collectively, “Guest”) and Richard Cook dba Vail Management Company (“Vail Management”), acting as agent for the fee Owner of the real Property. Each person comprising Guest is jointly and severally liable for the observance and performance of all terms, conditions and obligations of this Agreement required to be observed and performed by Guest. 

CANCELLATION POLICY:  

If Guest cancels this reservation thirty (30) or more days prior to the arrival date, the entire initial deposit less a $100.00 cancellation fee shall be refunded to Guest. 
If Guest cancels this reservation less than thirty (30) days prior to the arrival date, Guest shall NOT be entitled to the refund of any portion of any deposits paid by Guest.  
Deposits for accommodations during Holidays and non-refundable promos are NON-REFUNDABLE. 
Agent will not be held liable for circumstances beyond their control including but not limited to inclement weather, evacuation due to earthquakes, flooding, or other natural disasters, and NO REFUNDS will be issued under these circumstances. We encourage all renters to purchase Travel Insurance.
  1. DEPOSITS. All deposits will be held in an interest bearing advance deposit escrow account and the interest thereon shall be to the sole property of Vail Management. 
  2. CHECK IN time is 4:00 PM MST and CHECK OUT time is by 10:00 AM MST. Early or late arrivals and departures may be arranged with Vail Management in advance.  Any unauthorized check-outs between 10:00 AM and 12:00 PM will be charged a fee equal to 25% of one night’s rental fee. Any unauthorized check-outs after 12:00 PM will be charged a full day rack rate. 
  3. Primary guest must be over the age of 21 and be an occupant of the unit during the entire reservation period. 
  4. Agent commissions will not be paid on reservations with discounts. 
  5. KEYS: Guests who require lock out assistance because they misplaced their key will be charged a $50 service fee. 
  6. NO SMOKING IS ALLOWED INSIDE THE PROPERTY. Smoking inside of the Property is strictly prohibited at all times. Guest shall be responsible for all damage caused by the smoking, including but not limited to, stains, burns, odor and removal of debris. Guests violating this policy will be charged a minimum cleaning fee of $300 which shall be billed to Guest’s credit card. 
  7. Unless otherwise specified in the listing, PETS ARE NOT ALLOWED IN OR ON THE PROPERTY. If an unauthorized pet is in the Property, Guest shall be responsible for all damage caused by pet. Guest and Guest’s guests and invitees will be required to immediately leave the Property or be removed. If Guest is in breach of this no pet prohibition herein, Guest forfeits the right of the return of any unused Rental Fees. Guest violating this policy will also be charged a cleaning fee in the minimum amount of $400 and Guest’s credit card shall be charged for all costs incurred by Vail Management to repair any damage to the Property caused by the pet. 
  8. SMOKE DETECTORS – All properties have a smoke detector. Guest has the duty to notify Vail Management in writing of the need for replacement of or repairs to a smoke detector. Guest is required to check that all smoke detectors in the unit are in working condition immediately upon arrival, and promptly report any malfunction or damaged detector to Vail Management. 
  9. CARBON MONOXIDE DETECTORS. Each existing single-family dwelling or existing dwelling unit in a multi-family dwelling that is used for rental purposes is required to have an operational carbon monoxide alarm alarm installed within fifteen feet of the entrance to each room lawfully used for sleeping purposes or in a location as specified in any building code adopted by the state or any local government entity. Guest is required to check that all carbon monoxide detectors in the unit are in working condition immediately upon arrival, and promptly report any malfunction or damaged detector to Vail Management. 
  10. ENTRY AND INSPECTION.  Vail Management and Vail Management’s employees, contractors and agents shall have the right to enter the Property at any time in case of emergency.  Vail Management and Vail Management’s employees, contractors and agents shall further have the right to enter the Property upon twenty-four (24) hour notice (or such shorter time period as may be agreed to by Guest), to make necessary or agreed repairs, decorations, alterations, improvement, supply necessary or agreed services, and/or inspect the condition of the Property.  
  11. LAWS AND RULES AND REGULATIONS. Guest shall comply with all statutes, ordinances and requirements of all municipal, state and federal laws regarding the Property, including the use, possession, production or sale of illegal drugs. Guest further agrees to adhere to all rules and regulations set forth by the regulatory parties for the condominium complex or homeowners association in which the Property is located, including rules with respect to smoking, noise, odors, disposal of refuse, parking and use of common areas. 
  12. UNAVAILABILITY. If for any reason beyond the control of Vail Management, the Property is unavailable, or becomes unavailable, Vail Management may cancel this Agreement and refund in full to Guest all payments made hereunder by Guest. Vail Management will make every effort to provide suitable equivalent lodging but is under no obligation to do so. 
  13. INDEMNIFICATION AND WAIVER.  Guest will indemnify, defend and hold harmless Owner of the Property and Vail Management and their respective shareholders, directors, members, managers, representatives and agents from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest, Guest’s guests or invitees and their personal property arising out of Guest occupancy or use of the Property. Neither Vail Management nor Owner of the Property shall be liable for any damage or injury to Guest, or any other person, or to any property, occurring on the Property, unless such damage is the legal result of the gross negligence of Vail Management or Owner of the Property.   
  14. MAINTENANCE AND DAMAGE.  Guest shall be responsible for the actual cost to repair or replace any and all damages caused by Guest, Guest’s guests or invitees. Guest acknowledges that, unless Vail Management is notified immediately upon occupancy, the Property including the furniture, furnishings and appliances shall be deemed to be in good working order, condition and repair.  Guest shall keep the Property in a clean and sanitary condition, and shall immediately notify Vail Management of any damage to the Property or its contents, or any inoperable equipment or appliances.  Guest shall surrender the Property, at termination, in as good condition as received, normal wear and tear expected.  Guest shall not commit any waste upon the Property or any nuisance or act which may disturb the quiet enjoyment of any neighboring occupants.  Guest hereby acknowledges and agrees that insurance policies of Vail Management and Owner of the Property do not cover Guest’s personal property.  Damage from Ski Boots and/or Other Equipment.  Please be advised that ski boots and other recreational equipment can cause substantial damage to the interior of the Property.  Wearing ski boots, et al inside of the Property is strictly prohibited, except in entryways, ski rooms and mudrooms.  Any damage to the Property caused by ski boots or other improper footwear to carpeting, hardwood, tile, and stone floors shall be the repaired at the cost of Guest.   
  15. CREDIT CARD AUTHORIZATION.  Guest hereby authorizes Vail Management to charge all deposits, fees, costs and charges arising under this Agreement to the Guest’s credit card provided to Vail Management. The reversal of any charges to Guest’s credit card arising under this Agreement shall constitute a breach of this Agreement by Guest.  In the case of any reversal of charge by Guest, this provision shall serve as express permission to Vail Management to recharge the Guest’s credit card for payment or to collect such fees, costs and charges by any other legal means.  

I understand the terms and conditions of this reservation and authorize Vail Management to charge the balance due to the credit card provided.
